An attorney who once worked for the state’s social services agency claims Attorney General Jay Nixon’s office discriminated against her in not offering a job because she is a quadriplegic.
Marla Grothoff, of Columbia, earned her law degree in 1988 and went to work for the Missouri Department of Social Services. Ten years later, she moved into the agency’s child support enforcement division. In 2003, the attorney general’s office prepared to take over those duties and staff attorney jobs.
All attorneys from the Social Services Department had to re-apply for jobs in the attorney general’s office, and that office declined to offer a job to Grothoff.
Grothoff filed a lawsuit in late 2004 claiming Nixon’s office discriminated against her because of her disability. Nixon’s office denies the allegations, saying she did not get the job for reasons unrelated to her disability.
Grothoff first went to the Equal Employment Opportunity Commission, a preliminary step before filing suit. The EEOC said in a standard form that it could not conclude from its investigation that the attorney general’s office violated the law, but nor could it say the office was complying.
Her attorney, Dan Pingelton of Columbia, did not return calls seeking comment by press time.
A settlement conference is set for Friday before a federal judge in Jefferson City. U.S. Magistrate Judge John Maughmer ordered anything said at that conference to be kept confidential. Read more…
